Terms of Service

These terms govern your use of Ruff Night. By using the app you agree to them.
1. The service
Ruff Night reads your sleep data from Apple Health, calculates a score, and shows that score to friends you have approved. It includes a daily message feature called a Bork and an in-app currency called treats.

2. Not a medical device
Ruff Night is not a medical device and does not provide medical advice. The score is a calculation performed on sleep measurements recorded by your watch or ring. It is not a diagnosis, it does not detect sleep apnea or any other condition, and a high score is not evidence of good health.
Do not use Ruff Night to make health decisions. If you have concerns about your sleep, consult a doctor. In an emergency, contact emergency services.
Ruff Night is also not a monitoring or safety service. Notifications depend on your tracker syncing, network availability, Apple's push service, and the app running. Any of these can fail without warning. The absence of a notification carries no information about a person's wellbeing.
The score is our own calculation. It is modelled on Apple Health's sleep score for Apple Watch users but is not identical to it, and users of other trackers will see a number that differs from the one shown in their tracker's own app.
3. Your account
Ruff Night requires an Apple ID and iOS, and you sign in with Apple. You must be at least 13 years old. You are responsible for activity under your account.
Your display name is visible to friends you have added and appears in the notifications they receive.
4. Friends and Borks
Friendships are mutual. Both people see each other's sleep scores. A request can only be created using your six-character friend code, and the recipient must accept it. Either person can end the connection at any time.
Borks are limited to one per friendship per day and can be disabled entirely in the app's settings.
5. Treats and purchases
Treats are an in-app currency with no monetary value. They cannot be transferred between accounts, exchanged for money, or redeemed outside the app. Prices and earning rates may change.
Treat packs are consumable In-App Purchases sold by Apple. Apple's terms and refund process apply. We cannot issue refunds directly; request one at reportaproblem.apple.com. If a purchase completes and treats are not credited, contact us and we will correct it.
Deleting your account removes any remaining balance and everything it purchased. This cannot be reversed.
6. Acceptable use
You agree not to:
- Impersonate another person, or create an account to observe someone without their agreement.
- Harass other users, including through repeated Borks or friend requests.
- Attempt to access data belonging to accounts you are not connected to, or circumvent any limit enforced by the service.
- Submit false sleep data or interfere with how treats are credited.
- Automate, scrape, decompile or resell the service.
7. Availability
Ruff Night is provided as is, without warranty of availability or accuracy. It depends on Apple Health, Apple's push service, your tracker manufacturer and a hosted database, none of which we control. Features may change or be withdrawn.
We will give reasonable notice in the app before discontinuing the service or removing a feature you have paid for.
8. Content and ownership
Your sleep data and display name remain yours. You grant us only the permissions required to operate the service: to store your data, calculate a score from it, and show that score to friends you have approved. We do not use your data to train any system or provide it to third parties. See the privacy policy for details.
The app's artwork, name and software are our property and are not licensed to you beyond ordinary use of the app.
9. Termination
You may delete your account at any time from the app's settings.
We may suspend or remove an account that breaches these terms or harms other users. Except where a user is being harmed, we will contact you first.
10. Liability
To the fullest extent permitted by law, we are not liable for indirect or consequential losses arising from your use of Ruff Night, including any loss resulting from a notification not being delivered, a score being inaccurate, or data being unavailable. Where liability cannot be excluded, it is limited to the greater of the amount you have paid us in the preceding twelve months or twenty US dollars.
Nothing in these terms excludes liability for fraud or any other liability that cannot lawfully be excluded. If you are a consumer, your statutory rights are unaffected.
11. Changes
If these terms change, the effective date above is updated and material changes will be described here. Continuing to use the app after a change constitutes acceptance.
12. Governing law
These terms are governed by the laws of the State of California, USA, and its courts have jurisdiction, except where the law of your country of residence entitles you to bring a claim locally.
